HB26-1007 — what landlords
need to know.

Colorado HB26-1007 was signed by Governor Polis in May 2026 and takes effect January 1, 2027. The law gives Colorado renters the explicit legal right to install plug-in solar panels on their balconies, patios, and outdoor spaces.

YOU CANNOT PROHIBIT IT
Landlords and HOAs cannot prohibit or unreasonably restrict tenants from installing compliant plug-in solar devices.

WATTAGE LIMIT: 1,920W
Tenants may install up to 1,920W total system capacity. Most balcony kits are 395–800W — well within the limit.

NO UTILITY APPROVAL NEEDED
Tenants using meter collar adapters do not need utility approval. Standard outlet systems require no approval.

You may set reasonable restrictions on placement and aesthetics — but cannot prohibit installation entirely.

Add a balcony solar addendum to your lease agreement acknowledging HB26-1007 and setting reasonable installation guidelines — panel placement, removal on move-out, damage liability.

SET PLACEMENT GUIDELINES
You can set reasonable restrictions on where panels are placed — not blocking walkways, not permanently attached to the building structure, matching aesthetic standards. Document these in writing.

COMMUNICATE WITH TENANTS
Proactively tell tenants about the new law and your guidelines before January 1. Tenants who feel informed are less likely to dispute decisions about placement restrictions.
